Mass Tort Litigation
The legal practice of what used to be called class action lawsuits has developed into an area of the law now generally described as mass tort litigation. Basically, mass tort litigation refers to a situation where a widely distributed product results in a certain type of injury or sickness to a large number of that product’s users, even when used exactly as recommended and designed. Many of these products are pharmaceuticals or medical devices. One of the first and most recognizable of these products was asbestos. Some are as common and widespread as talcum powder. Talcum powder cases are currently being pursued. Mass tort cases are usually consolidated into a few specific geographic areas and jurisdictions for trial. It is common for law firms to collaborate on these types of cases. Some of the other products that are currently being investigated are Essure, Zimmer Taper Hips, Roundup herbicide, hernia mesh, and IVC filters. One particularly interesting product being investigated is the 3M Combat Arms earplugs that were widely distributed to military personnel. The allegations are that the ear plugs were defective and allowed hearing loss to develop in a large number of soldiers. News of new products being investigated appears regularly.
